Understanding Miami Condo Rental Restrictions
Rental restrictions are set at the individual building level through the declaration of condominium, and they can range from unrestricted short-term rentals to strict owner-occupancy requirements.
Common restriction types
- Minimum lease terms — commonly 6 or 12 months in more restrictive buildings.
- Annual rental caps — a maximum number of leases per unit per year.
- Approval requirements — some associations require board or management approval of tenants.
- Owner-occupancy periods — a required period of personal use before a unit can be rented at all, sometimes used in newer buildings.
Because associations can amend these rules over time (subject to their governing documents), buyers planning to rely on rental income should review both the current rules and the amendment history where available. Contact Diego to confirm current rental policy on a specific development.
