A Guide for Foreign Buyers of Miami Real Estate

Miami's new-construction market draws a large share of international buyers, and foreign nationals can generally purchase real estate in Florida without restriction on citizenship or residency status. That said, several considerations are different for international buyers than for U.S.-based buyers.

Considerations that differ for international buyers

  • Financing — foreign national loan programs exist but typically require larger down payments and different documentation than domestic financing.
  • Tax reporting — U.S. tax obligations, FIRPTA withholding on future resale, and reporting requirements in the buyer's home country should be reviewed with a qualified cross-border tax professional.
  • Estate planning — how title is held (individual, LLC, trust) can materially affect estate and tax outcomes for non-U.S. citizens.
  • Currency and wire logistics — international wire transfers for deposits and closing require lead time and, often, source-of-funds documentation under U.S. anti-money-laundering rules.
  • Remote closing — many international buyers complete the process remotely, including document signing and deposits, without traveling to Miami.
