Assigning a Pre-Construction Contract in Miami
An assignment lets the original buyer transfer their purchase contract — and their equity in it — to a new buyer before closing, without ever taking title themselves. Some Miami developers allow this; many restrict or prohibit it.
What typically determines assignability
- The purchase agreement's specific assignment clause — this is developer- and sometimes phase-specific
- Any assignment fee payable to the developer
- Whether the developer must approve the assignee
- Timing restrictions (for example, no assignments within a set period before closing)
Why it matters for buyers
If part of your strategy depends on the ability to sell your contract before closing, assignment rights should be confirmed — and understood in detail — before you sign, not after.
